Land dedicated as a public road at common law, which became vested in the Crown by operation of s 369 of the Land Act 1962 (Qld), is effectively removed from the Torrens registration system. The indefeasibility provisions of the Land Title Act 1994 (Qld) cannot defeat the Crown's statutory ownership of such land, even where a certificate of title has been issued to and registered in the name of a private party. The vesting continues under s 95 of the Land Act 1994 (Qld), read with s 454. Developers and purchasers of land in Queensland that may historically have been used as public laneways cannot rely on indefeasibility of registered title to defeat the Crown's ownership.
