Estoppel by convention may in principle arise in non-contractual 'course of dealing' cases in Australia, but mutual unawareness of a limitation period, without communication and mutual adoption of a shared assumption as the basis of the parties' relationship, is insufficient to found such an estoppel. A solicitor's unilateral, unresearched assumption about the jurisdiction of existing proceedings does not constitute the adoption of a shared assumption for the purposes of estoppel by convention. The cause of action for breach of contract arising from failure to complete on the contractual date accrues on the day following the completion date, not on the date of an earlier repudiation that was not accepted.
