The uplifted sentencing practice called for in Gregory for trafficking in commercial quantities of methylamphetamine is not the determinative or controlling factor in sentencing; in light of Dalgliesh, the sentencing exercise must account for all individual factors relevant to the particular case. The 13-15 year range suggested in Gregory was obiter and specific to the facts of that case. A sentence of 10 years for trafficking in a commercial quantity of methylamphetamine — the highest ever imposed in Victoria for that offence — was manifestly excessive where the offending lacked the aggravating features of violence and intimidation present in Gregory and was of a significantly lower scale than comparable cases.
