A trust beneficiary who was actively involved in the management and accounting of trust affairs, and who enters into a comprehensive settlement with releases after receiving professional advice, will not be permitted to set aside those releases on the basis of alleged non-disclosures relating to matters within the beneficiary's own knowledge or responsibility. The assessment of whether a beneficiary had 'full knowledge' for the purpose of releasing a trustee from breach of trust is not a mechanical inquiry but is assessed by reference to the whole circumstances and notions of fairness, including the beneficiary's own role in creating the informational deficiencies complained of.
