In assessing damages for loss of a commercial crop, a trial judge may accept the evidence of a qualified employee witness on likely yield where that evidence is unchallenged in cross-examination, even where the witness was not called as an expert and the yield data was limited. A defendant who fails to challenge a plaintiff's damages calculation at trial, or to put its alternative yield calculations to relevant witnesses, will face significant difficulty challenging the assessment on appeal.
