The Magistrates' Court has jurisdiction to hear and determine summarily a charge of attempting to obtain a financial advantage by deception (and analogous attempt offences) even where the amount of the attempted financial advantage exceeds $100,000, because the attempt offence under item 4.28 of Schedule 2 is not itself qualified by reference to any monetary limit. The earlier decision in Otte v Magistrates' Court of Victoria should not be relied upon. The discretion under s 29 remains the safeguard against inappropriate summary determination of serious attempt charges.
