Criticisms of an expert witness's evidence, even if valid, do not establish apprehended bias on the part of the judge who received that evidence. An appeal against specific orders cannot be used as a vehicle to challenge earlier orders made years prior against which no timely appeal was brought, particularly where extensive further litigation has proceeded on the basis of those earlier orders. Documents already received into evidence at trial on a compact disc cannot be treated as fresh evidence on appeal.
