A representation by a lender's agents that a loan 'would be rolled over' at the end of its term if the borrower was not in default is arguably sufficiently clear to found an equitable estoppel, particularly where the representation is made against the background of an established commercial practice of rolling over such loans. The question of whether such an estoppel is established is not appropriately resolved on a summary judgment application where the borrower's evidence, if accepted, is reasonably capable of establishing the estoppel.
