The increased maximum penalty of life imprisonment for possession of trafficable quantities of methylamphetamine (28g or more) under the 2017 amendment to the Misuse of Drugs Act 1981 (WA) must be taken into account in sentencing and indicates that sentences for methylamphetamine trafficking should increase. A total effective sentence of 13 years' imprisonment for commercial dealing involving approximately 978g of methylamphetamine, 630g of cocaine, 138g of MDA and $33,075 cash was upheld as not unreasonable or plainly unjust, even where the offender was acting as agent for another person.
