Section 286(1) of the Local Government Act 1960 (WA), as amended in 1962, operates immediately, automatically and unconditionally to remove land dedicated as a road from the operation of the Transfer of Land Act 1893 (WA), regardless of whether the council has given notice under s 364(7) or the Registrar of Titles has recorded the revesting. Consequently, a registered proprietor cannot claim indefeasible title under s 68 of the TLA to land that has been so dedicated and removed from the TLA's operation. The purpose of s 364(7) is administrative — to record in the Register something that has already occurred by force of statute.
