Under s 9AA(2) of the Sentencing Act 1995 (WA), the benefits to the State resulting from a guilty plea are to be assessed at the time of sentence, not at the time the plea is first indicated or entered. Admissions made to police that are distinct from an indication of a guilty plea may be taken into account in assessing the strength of the prosecution case for s 9AA purposes, provided the mitigating effect of those admissions is separately recognised. A sentencing judge does not err by proceeding on uncontested evidence, and the subsequent emergence of a lower damage estimate will not constitute a miscarriage of justice where the sentencing judge's finding was expressed in broad terms that remain accurate on either estimate.
