Where a services provider communicates a diagnosis and offers to perform repair work, and the customer expressly agrees during the conversation, a bilateral contract is formed at that point — even if the customer is also required to supply a part as a condition precedent to performance. The customer's obligation to supply the part is a condition precedent to the provider's performance obligation, not to the formation of the contract. The arrangement for the customer to obtain the part does not convert the offer into one capable of acceptance only by the act of delivery (a unilateral contract). The question whether a bailor may countermand instructions under a contract for work on bailed goods was left open.
