In appeals from care and protection orders under the Children and Young People Act 2008 (ACT), the Court of Appeal's power is limited by s 838 to orders that could have been made by the Children's Court, and s 433 precludes interim care and protection orders where no application for a care and protection order is pending before the court. Orders seeking to change residence or set aside final orders are substantive in nature and not appropriate for interlocutory relief in an appeal.
