Pre-sentence custody that has been specifically credited by a Magistrate in sentencing for separate offences need not be credited again by a sentencing judge dealing with different offences, even where the custody periods overlap. A sentencing judge may treat such prior custody as part of the offender's criminal record rather than as time to be credited under s 63 of the Crimes (Sentencing) Act 2005 (ACT).
