In the ACT, security for costs will not ordinarily be ordered in personal injury appeals where the appellant is impecunious and the order would stifle the appeal, even where the grounds appear weak as a matter of impression. The court will not undertake a detailed assessment of the merits on a security application. Poor drafting of grounds of appeal does not render an appeal incompetent under r 5472 where the appeal exists as of right and is filed within time; competence relates to the capacity of the appeal to invoke the court's jurisdiction.
