The parity principle applies even where co-offenders are charged with different offences of varying seriousness arising from the same incident; courts must consider relative culpability as asserted by the Crown or found by the sentencing judge, and must not allow the parity principle to be prescribed by the manner in which prosecutorial discretion is exercised. The prospect of deportation cannot be used to reduce an otherwise appropriate sentence, consistently with Ngata v The Queen [2020] ACTCA 18.
