Even where a Tribunal is found not to have had conscious regard to prejudicial information (defeating a materiality-based procedural fairness claim), a claim of apprehended bias may still succeed if the information was sufficiently prejudicial that a fair-minded lay observer might apprehend subconscious influence on the decision-maker.
