Non-citizens facing visa cancellation on character grounds cannot ground a claim of indefinite detention on non-refoulement obligations alone, as ss 197C and 198 require removal irrespective of such obligations; however, where there are practical impediments to removal (e.g., statelessness or country of origin refusing to accept the person), the reasoning in DQM18 may require the decision-maker to assess the realistic prospect of another visa being granted.
