Where a defendant is liable for both misleading and deceptive conduct and deceit, the apportionment defence under CLA Part 4 is unavailable because s 34A(1)(b) excludes fraudulent concurrent wrongdoers from the benefit of apportionment. Partners are liable for misleading representations made in the ordinary course of partnership business regardless of personal knowledge.
