An appellant who challenges a conviction on the ground of unfitness to stand trial impliedly waives legal professional privilege over communications with trial lawyers concerning the appellant's instructions, understanding of advice, and fitness, where the appeal assertions necessarily lay open those communications to scrutiny. This waiver does not extend to fitness hearings at first instance where neither party carries an onus of proof. The scope of waiver is limited to the period covered by the assertions made on appeal.
