When sentencing for aggravated enter dwelling-house offences under s 111(2) of the Crimes Act 1900 (NSW), the sentencing judge is required to have regard to the specific type of weapon used and the nature of the entry into the dwelling in assessing objective seriousness, notwithstanding that being armed and entering a dwelling-house are elements of the offence. Such consideration does not constitute impermissible double counting under s 21A(2) of the Crimes (Sentencing Procedure) Act 1999 (NSW).
