Where co-offenders are sentenced by different judges, differences in the evidence before each judge (including oral evidence given by one co-offender but not the other) may explain apparent disparity in sentences. A sentencing judge taking into account a s 16BA schedule offence is not required to use a descriptor to indicate the weight given to that offence. There is no standardised language for assessments of objective seriousness, and descriptors used by different judges cannot be precisely compared.
