Where multiple counts of sexual assault against a single complainant arise from events that are temporally and contextually intertwined as part of a continuous sequence, an acquittal on one count that is explicable only by doubts as to the complainant's credibility will render guilty verdicts on the remaining counts inconsistent. Y-filer DNA evidence detected from genital swabs taken more than 12 hours after alleged sexual contact, in the absence of semen, may be more consistent with secondary transfer than with the alleged offending, and the 'CSI effect' may cause juries to give such evidence unwarranted weight.
