A sentencing court is not bound by an offender's assertions as to their role in a criminal enterprise and must make factual findings on the whole of the evidence, including intercepted communications. Sentencing statistics are of little or no utility in establishing manifest excess absent detail of the individual cases reflected in the data. Considerable obstacles face an applicant contending parity error where the same judge sentenced both co-offenders with express regard to the parity principle.
