Applications for suppression or non-publication orders concerning proceedings in the Supreme Court must be made to the Supreme Court, not to the District Court. Section 7 of the Court Suppression and Non-publication Orders Act 2010 does not on its face authorise a court to make orders in respect of proceedings before a different court. Seeking such orders from a lower court after the Supreme Court has addressed the topic may constitute an abuse of process. Parties dissatisfied with suppression orders should use the review mechanism under s 13 or appeal under s 14, rather than applying to a different court.
