Where the objective gravity of kidnapping with actual bodily harm is at or towards the bottom of the range and the offender's subjective case is strongly favourable, a sentence of 20 months' imprisonment is manifestly excessive; 12 months is appropriate. A sentencing judge's observation that an ICO 'reflects a significant degree of leniency' is not an error of principle. Where a sentencing assessment report indicates that Community Corrections will suspend supervision due to low risk of reoffending and no community service work is available due to the violent nature of the offence, the sentencing judge is entitled to take those matters into account in declining to impose an ICO.
