Form 1 offences cannot be treated as aggravating the objective seriousness of the substantive counts to which they are attached; their relevance is limited to demonstrating an additional need for personal deterrence and retribution. Where sentencing error is established but the Court on resentence considers greater sentences were warranted for some counts, the appeal will be dismissed if the aggregate sentence warranted in law exceeds the aggregate sentence under appeal.
