The assessment of objective seriousness in sentencing is an evaluative process (per Simpson AJA) or discretionary process (per Salafia), and appellate error will only be found where there has been a failure in the proper application of principle. Where co-offenders are sentenced by the same judge in the same proceedings, the appellate court will be cautious and not overly willing to intervene on parity grounds, as the sentencing judge is best placed to assess the interrelationship between objective and subjective features.
