A sentence of seven years' imprisonment with an SVO declaration for rape by fisting (domestic violence offence) committed on the same occasion as two other rapes was manifestly excessive where the offending did not result in grievous bodily harm; the appropriate sentence was seven and one-half years without the SVO declaration. Pre-s 9(10A) comparable sentences for domestic violence offences should be treated with caution as they do not reflect the current statutory aggravating factor.
