For the purposes of s 493(2) of the Environmental Protection Act 1994 (Qld), a corporation commits the offence under s 437(1) only when serious environmental harm actually results from the corporation's causative wilful act, not when the causative act is performed. Executive officers are only liable under s 493(2) if they held office at the time the harm was actually caused. The prosecution need not prove any connection between the executive officer and the corporation's causative act — the question of the officer's connection to the causative act and its consequences is a matter for the statutory defences under s 493(4).
