Section 27(1)(b)(i) of the Personal Injuries Proceedings Act 2002 (Qld) requires disclosure of information about prior similar incidents (including complaints about an alleged abuser made by other persons, whenever those complaints were received) where such information is capable of being regarded as information about 'the circumstances of, or the reasons for' the incident alleged in the notice of claim. The disclosure obligation is not confined to information about prior incidents having a demonstrated causative effect. Where the claim alleges omissions to prevent abuse, complaints about the alleged perpetrator's conduct during the relevant period are capable of explaining why the omission occurred and are therefore disclosable, regardless of when the complaints were received.
