In a cost-plus EPC contract, a sole remedy clause for failure to achieve Mechanical Completion (cl 24.7) does not bar a claim by the principal to recover overpayments under the pricing provisions, because such a claim is not a 'remedy' for breach but rather a claim arising from the operation of the pricing terms. Where a contract defines 'Actual Costs' in both a general clause and a schedule, the schedule definition does not override the exclusion of 'Excluded Costs' from the general definition unless the schedule expressly provides otherwise. A clause precluding claims arising from 'any delay and disruption to the progress of the Work' is not confined to delays caused by Delay Events but extends to all delays, including those caused by the contractor's own default.
