A single judge of the Queensland Court of Appeal has power under s 44(2)(a) of the Supreme Court of Queensland Act 1991 to extend time for filing a notice of appeal under r 748 UCPR, but does not have power to determine a reasonably arguable question whether an order against which a party purports to appeal was or was not made, as that goes to the merits of the appeal. A statement in reasons that an application is 'otherwise dismissed' does not constitute the making of an order where the only order pronounced in court was for submissions on the form of orders. Where the recoverable amount of a costs assessment claim depends on a future determination on quantum, the claim may not relate to 'property that has a value' within s 118(2)(b) of the District Court of Queensland Act 1967.
