Where the allocutus is administered in terms of an offence different from that to which the accused pleaded guilty, there is no valid acceptance of the guilty plea and the sentencing proceedings miscarry. A marginal note on an indictment stating the wrong statutory provision is a formal defect, but if it leads to the allocutus being administered for the wrong offence, the sentencing is vitiated.
