Section 21A(4) of the Evidence Act 1977 (Qld) does not require the accused to be able to see and hear a special witness during pre-recording where the accused is excluded from the courtroom but the special witness gives evidence from a separate room; the provision applies only to exclusion from the room in which the special witness is giving evidence. The question whether s 617(1) of the Criminal Code applies to pre-recording hearings was expressly left open.
