The court's discretion to dismiss for want of prosecution is not fettered by rigid rules but takes into account all relevant circumstances, including that ordinary members of the community are entitled to plan their affairs without the continuing threat of litigation. Costs thrown away by an adjournment caused by a party's default may be ordered on the standard basis rather than the indemnity basis where the costs applicant was merely a supporter to the application rather than the moving party or the estate administrator.
