The discretion to fix a parole eligibility date is unfettered and there is no inflexible rule that a plea of guilty must result in a parole eligibility date at one-third of the head sentence. Where a sentencing judge declines to make a serious violent offender declaration, it is an error to automatically fix parole eligibility at one-third without separately considering punishment, denunciation, deterrence and community protection.
