Where a legal practitioner is medically unfit to practise and unresolved disciplinary proceedings exist in the Tribunal, the appropriate course is for the Commissioner to bring the striking off application rather than proceeding on the practitioner's own application. Striking off applications should be heard publicly, not in private, given the public interest in transparency.
