Under ss 71 and 72 of the Workers Rehabilitation and Compensation Act 1988 (Tas), once a worker meets either the 5% physical impairment threshold in s 71(1) or the 10% psychiatric impairment threshold in s 71(2), s 72(2)(b) permits combining physical and psychiatric impairments to assess whole person impairment for lump sum compensation, without requiring both thresholds to be independently satisfied. However, psychiatric impairment cannot contribute to meeting the 5% threshold in s 71(1) itself. Whether a physical impairment below 5% can be combined with a psychiatric impairment meeting the 10% threshold was left open.
