An arguable ground of appeal does not compel the grant of an extension of time; the test for extension is distinct from the test for leave. Where the delay is inordinate and inadequately explained, and success on appeal would likely result in no lesser sentence on a substituted offence, the interests of justice may not favour extension. Solicitors have an obligation to take steps to ensure timely filing or return the brief, and counsel's heavy workload is a weak justification for delay.
