An aggregate sentence will rarely, if ever, be appropriate where there are only two charges and one is much more serious than the other. Where an offender breaches a CCO, reduced rehabilitation prospects may justify a change in the structure of the sentence but not a significant increase in severity. The obligation to give full weight to an offender's deprived background under Bugmy applies equally on resentencing following breach of a CCO, and those circumstances necessarily moderate the judgment to be made about non-compliance.
