A sentencing judge who changes their previously expressed views on matters such as rehabilitation prospects based on events occurring after the plea hearing must notify the parties and provide an opportunity for further submissions before making adverse findings. However, a finding of procedural unfairness in sentencing will not result in resentencing where the offending is sufficiently serious that the sentence imposed was appropriate regardless of the error. In serious white collar fraud cases, good character and strong rehabilitation prospects carry reduced weight in sentencing.
