A sentence of 15 months' imprisonment for stalking involving persistent conduct over approximately 71 days (including following the victim, chasing her, and numerous calls and messages) in a family violence context was held to be moderate, if not lenient. The total effective sentence of 3 years and 7 months for stalking, aggravated burglary with a meat cleaver, and property damage was similarly characterised as lenient. Two VSCA stalking decisions (Lade and Elfata) were held to be of limited comparative value due to materially different offending and offender circumstances.
