A sentence of 3 years' imprisonment with a 2-year non-parole period for intentionally causing bushfires during a fire danger period with extreme fuel hazard ratings is within range even where the offender has reduced moral culpability due to a neurodevelopmental disorder, an early guilty plea, remorse, and the totality principle applies. Neurodevelopmental disorders including ADHD are encompassed within the Verdins sentencing principles. A CCO is not a realistic alternative where the offender has a history of non-compliance with court orders and difficulties with authority.
