There is no automatic discount for delay in sentencing; the most that can be said is that where prosecuting authorities have unduly delayed bringing the matter to court, there is more likely to be a discount. A finding of premeditation relevant to the gravity of the charged offence does not constitute impermissible sentencing for an uncharged offence of aggravated burglary where the facts do not establish the elements of that offence. Offending committed in a custodial setting requires particular weight to be given to specific deterrence, general deterrence, community protection and denunciation.
