Grounds of appeal that are ultimately found to be without merit do not automatically justify indemnity costs; the threshold for a special costs order requires that the grounds be self-evidently hopeless or pursued for an illegitimate advantage. A party's concession during oral argument that evidence contradicts their written case should not be penalised by an indemnity costs order.
