Where an offender has a traumatic brain injury and autism spectrum disorder that diminish their understanding of the moral gravity of their conduct, both general and specific deterrence must be sensibly moderated, and a sentence of imprisonment may be manifestly excessive where a community correction order with treatment conditions is available. A sentence of 3 years and 6 months' imprisonment for sexual penetration of a child under 16 was manifestly excessive for a youthful offender with these conditions, and was replaced with 12 months' imprisonment followed by a 2-year CCO.
