Where a substantial period remains before the expiry of a non-parole period, the prospects of success on appeal must be correspondingly stronger to establish exceptional circumstances for bail pending appeal. Arguable grounds alone are insufficient where years remain to be served and the appeal will be heard well before the non-parole period expires. Personal circumstances including advanced age, health issues, family support, bail compliance history and substantial sureties do not, alone or in combination, constitute exceptional circumstances.
