A springing order extension will not be granted where the applicant has a history of non-compliance, obtained the original extension on misleading representations, and provides no evidence of capacity to comply within any further extended timeframe. The existence of a possibly arguable appeal does not insulate a party from the consequences of failing to comply with a peremptory order.
