A notice to produce under r 6748 of the Court Procedures Rules 2006 (ACT) may be set aside where the documents sought are not relevant, the notice is oppressive, compliance is impractical, or the notice is an abuse of process. Categories of documents in a notice to produce will not be read down by the Court to imply a standard of reasonableness. In a security for costs application, only documents arising proximately to or after the filing of the application for leave to appeal, and relating to counsel on record, are likely to be relevant.
